Terms of use for the SafetyNet platform and related services.
Terms of Use
1. Definitions
- "App" means the HCS Safety mobile application.
- "Content" means any data, text, images, documents, or other materials you submit via the App.
- "Services" means the App and all related backend and support services, including account management, forms, training, safety alerts, read/sign functionality, news, organisations, and related features.
- "we", “us”, “our” means HCS Safety.
- "you", “your” means the user of the App and/or the organisation you represent.
2. Acceptance and Eligibility
By downloading, installing, or using the App, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the App.
You must:
- Be at least 16 years old
- Have authority to bind yourself or your organisation
- Comply with any agreement between your organisation and us
3. Account and Access
You must:
- Provide accurate and complete registration information
- Keep your account information up to date
- Maintain the confidentiality of your password
- Notify us promptly of any unauthorised access
You are responsible for all activity under your account.
We may suspend or terminate access if you breach these Terms or for operational, legal, or security reasons.
4. Use of the Services
You may use the App only for lawful purposes and in accordance with these Terms.
You must not:
- Violate any applicable laws or third-party rights
- Attempt unauthorised access to systems or data
- Interfere with or disrupt the Services or other users
- Upload malicious software or harmful content
- Scrape or automate access without permission
- Send spam or unsolicited communications
You must also comply with your organisation’s policies when using the App.
Access to certain features may depend on your organisation’s subscription and your assigned role.
5. Description of Services
The App and backend provide functionality including:
- Account management and authentication
- Optional biometric login and app unlock
- Profile, signature, and initials management
- Safety alerts, including location and What3Words integration
- Forms management, including completion and attachment upload
- Read/Sign document functionality
- Training record and certificate management
- News, organisations, and client location management
- Push notifications via Firebase Cloud Messaging
- Session management, including automatic timeout
We use third-party services as described in our Privacy Policy.
We do not guarantee uninterrupted or error-free operation.
6. Your Content and Licence
You retain ownership of Content you submit.
You grant us a worldwide, non-exclusive, royalty-free licence to:
- Use
- Store
- Process
- Disclose
your Content as necessary to:
- Provide the Services
- Comply with legal obligations
- Enforce these Terms
You confirm that:
- You have the right to submit the Content
- The Content does not infringe third-party rights
7. Intellectual Property
The App, backend, and all related materials are owned or licensed by us.
You may not:
- Copy
- Modify
- Distribute
- Create derivative works
without our written consent, unless permitted by law.
Third-party trademarks remain the property of their respective owners.
8. Disclaimers
The Services are provided “as is” and “as available”.
We do not guarantee that the Services will be:
- Uninterrupted
- Secure
- Error-free
We are not responsible for the accuracy of Content submitted by you or your organisation.
Safety-related features are tools to support your organisation’s processes and do not replace professional health and safety advice or legal obligations.
9. Limitation of Liability
To the maximum extent permitted by law, we and our affiliates shall not be liable for any:
- Indirect
- Incidental
- Special
- Consequential
- Punitive
loss or damage arising from the Services.
Our total liability shall not exceed:

Nothing in these Terms limits liability that cannot be excluded by law, including:
- Death or personal injury caused by negligence

10. Indemnity

- Your breach of these Terms
except where caused by our breach or negligence.
11. Termination
You may stop using the App at any time.
You may request account closure by contacting us.
We may suspend or terminate access immediately if:
- You breach these Terms
- Required for operational, legal, or security reasons
Upon termination:
- Your right to use the App ceases immediately
- Relevant provisions survive termination, including liability, indemnity, and governing law
12. Governing Law and Disputes
These Terms are governed by the laws of England and Wales.
Disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, unless mandatory consumer protections apply elsewhere.
13. General
These Terms and the Privacy Policy constitute the entire agreement between you and us.
If any provision is invalid, the remainder remains in force.
Failure to enforce any provision does not waive our rights.
We may assign our rights and obligations. You may not assign yours without our consent.
14. Changes
We may update these Terms.
We will post updated versions in the App and/or notify you where required.
Continued use after changes take effect constitutes acceptance.
If you do not agree, you must stop using the App.
